A 21-year-old Kailua-Kona man is no longer facing robbery, assault and theft charges in connection with a November robbery in downtown Kailua-Kona.
The charges of first-degree robbery, first-degree assault and third-degree theft against Alexander Palani Miller were dismissed following a written motion by prosecutors during a continued preliminary hearing before District Court Judge Joseph P. Florendo Jr., according to attorney Robert Kim, who represented Miller. The state told the court it could not prove its case based on the confession of Kainoa Bryan, who is also facing charges in connection with the Nov. 26 incident that sent a 26-year-old Kealakekua man to the hospital with a fractured jaw and scrapes.
According to Kim, police reports and video revealed Bryan had confessed that he and others had been involved in the incident. Bryan further stated, according to Kim, that “Miller was not there, and that he (Bryan) was the African-American male that attacked the victim.”
Miller, unable to post bail, remained in custody for 18 days, according to Kim.
